By using the Site, you consent to the collection and use of information as described in the Privacy Policy, subject to the privacy choices and rights available to you under applicable law.

Where an applicable law gives you the right to withdraw consent, opt out of certain processing, or limit certain uses of information, you may exercise those rights through the methods described in the Privacy Policy and the privacy controls provided on the Site.

10. BINDING ARBITRATION

Informal Resolution First

Before beginning arbitration, the person or entity raising a dispute must send written notice describing the dispute, the facts supporting it, the requested relief, and contact information to:

Wondermom Wannabe, LLC
32 Arrowhead Drive, Suite 112
Ruby, VA 22545

The parties agree to make a good-faith attempt to resolve the matter informally for at least 30 days after the notice is received.

Agreement to Arbitrate

Except for the limited exceptions stated below, any dispute arising from or relating to the Site, these Terms, the Privacy Policy, our vendors or service providers, or your relationship with Wondermom Wannabe will be resolved through binding individual arbitration rather than a lawsuit in court.

This agreement applies to claims based on events that occurred before or after the effective date of these Terms to the extent permitted by law.

The Federal Arbitration Act governs this arbitration provision.

Exceptions

Either party may bring an eligible individual matter in small claims court, provided it remains an individual matter.

Either party may also seek appropriate court relief relating to infringement or misuse of intellectual property rights.

Arbitration Provider and Rules

Arbitration will be administered by JAMS under the JAMS rules applicable to the dispute at the time arbitration begins.

The arbitration may occur remotely, through written submissions, or at another mutually agreed location, as permitted by the applicable JAMS rules.

If JAMS is unavailable, the parties will agree upon another established arbitration provider.

Individual Proceedings

Arbitration must proceed on an individual basis except for the coordinated procedure described below.

Neither party may bring or participate in a class, collective, consolidated, or representative proceeding seeking relief on behalf of other users.

An arbitrator may award the same individual remedies that would otherwise be available in court when permitted by law.

Coordinated Similar Claims

If 50 or more substantially similar individual arbitration demands are submitted against us within approximately 30 days or another closely related period and are represented or coordinated by the same or related counsel or organizations, the similar matters may be administered in coordinated groups under procedures established by JAMS.

This provision does not authorize class arbitration. Each individual retains an individual claim and individual rights.

Authority of the Arbitrator

The arbitrator has authority to determine disputes concerning the interpretation, applicability, formation, and enforceability of this arbitration provision, except where applicable law requires a court to decide a particular issue.

The arbitrator may award individual monetary or nonmonetary relief available under applicable law.

The arbitrator's award will be final and binding subject to the limited review available under applicable arbitration law.

Jury Trial Waiver

To the extent permitted by law, both you and Wondermom Wannabe waive the right to have covered disputes decided by a judge or jury in court.

Time Limit

To the extent permitted by applicable law, a claim covered by this section must be initiated within one year after the event giving rise to the dispute.

Severability and Survival

If part of this arbitration provision is found unenforceable, the remaining portions will remain effective to the fullest extent permitted by law.

This arbitration provision survives termination of your relationship with Wondermom Wannabe.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WONDERMOM WANNABE, LLC, ITS OWNERS, AFFILIATES, VENDORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE OR ITS CONTENT.

THIS INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOSSES RELATING TO PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID DIRECTLY TO WONDERMOM WANNABE FOR THE PRODUCT OR SERVICE DIRECTLY GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

(B) ONE HUNDRED U.S. DOLLARS ($100).

These limitations apply regardless of the legal theory asserted and even if a party has been informed that damages may occur.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

12. NO WARRANTIES

The Site and its content are provided on an "as is" and "as available" basis to the fullest extent permitted by law.

We do not guarantee that every piece of information will always be accurate, complete, current, uninterrupted, or suitable for every purpose.

We may modify, remove, update, or discontinue Site content or features at any time.

13. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Wondermom Wannabe, LLC and its owners, affiliates, contractors, vendors, and service providers from claims, liabilities, damages, costs, and expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person's rights.

14. GOVERNING LAW

Except where federal law or the arbitration section governs, these Terms will be governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

15. CHANGES TO THESE TERMS

We may revise these Terms periodically.

When material changes are made, the effective date at the top of this page will be updated. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

16. SEVERABILITY

If a provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

17. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional terms associated with a specific product, membership, subscription, promotion, or service, constitute the applicable agreement between you and Wondermom Wannabe concerning your use of the Site and those offerings.
